Timeline of a Domestic Violence Investigation


If police respond to your home for an investigation of a domestic violence incident they will attempt to talk to both parties involved and any third party eyewitnesses.


If you are under suspicion for a domestic violence incident then an officer will attempt to contact you in order to get you to admit to your involvement in the incident. You have the right to decline to speak to officers and/or make any statements regarding what happened. More often than not speaking to an officer will not help you. If you do choose to make statements those statements can help an officer develop probable cause to place you under arrest.


Officer's are looking to determine who was the predominant aggressor. Dominant aggressor is the person determined to be the most significant, rather than the first, aggressor. Even if you did not start the fight you could still be charged with assault while the other person gets off free. It is important to talk to an attorney before making any statements!
