Gun Violence in Colorado is Increasing and the Consequences are Severe

A firearm charge in Colorado can result in serious consequences beyond jail time and fines, especially if you are a juvenile or not a U.S. citizen.


If you are already convicted of a felony being found in possession of a handgun is a class 6 felony and a mandatory sentence of 1-1.5 years in prison as well as a fine up to $100,000.


As a juvenile a judge can sentence you between 3 to 12 months of jail. If your child has been charged with a gun possession charge it is imperative that you call us right away.


Simply possessing an unregistered firearm can result in 6 to 18 months of jail and up to a $5,000 fine.


Menacing with a weapon can be considered an "aggravated felony" in the eyes of immigration and result in serious immigration consequences.


Pointed gun

Menacing C.R.S. 18-3-206, defines menacing as using threats or actions knowingly to place, or to attempt to place, another person in fear of imminent serious bodily injury or death. Menacing is a felony offense punishable by up to 3 years in prison.


Serious bodily injury means injury either at the time of the actual injury or at a later time, involves substantial risk of death, a substantial risk of serious permanent disfigurement, a substantial risk of protracted loss or impairment of the function of any part or organ of the body, or breaks, fractures, or burns of the second or third degree.


A person can be charged with menacing with or without a weapon. If there is no deadly weapon involved then a person can still be charged with a misdemeanor menacing punishable by up to 364 days in jail.


Examples of other deadly weapons that can result in a deadly weapon are: guns, knives, bats, torches, metal tools, chainsaws, blowtorches, fists (depending on the circumstances) and any hidden object you represent to be a deadly weapon.
